Privacy policy
What we collect, why we collect it, and how to get it back or get rid of it. Written to be read rather than skimmed past.
1. Who we are
Daygent ("Daygent", "we", "us") provides an AI receptionist that answers inbound phone calls for small businesses, answers callers' questions, takes booking requests and sends confirmations and reminders.
This policy explains what personal data we handle, why, and what rights you have over it. It covers our website, our onboarding flow, the customer dashboard and the call answering service itself. We are the data controller for the data described in section 3, and you can reach us at oliver@usedaygent.com.
2. The two roles we play
Daygent sits between two different groups of people, and the law treats them differently. Which part of this policy applies to you depends on which one you are.
- If you are a Daygent customer
- You signed up for an account and we answer your business's calls. For your account, billing and business data, we are the controller — we decide what is collected and why, and this policy governs it.
- If you called a business that uses Daygent
- The business you rang is the controller of your call. We are its processor: we handle the recording, transcript and booking details on that business's instructions and under a contract with them. Ask that business for its own privacy notice, and send requests about your data to them first — we will help them respond. If you cannot identify the business, contact us and we will route it.
3. What we collect
- Account data
- Your name, email address and a securely hashed password. We never store your password in a readable form.
- Business data
- Your business name, website address and the phone number you want answered.
- Knowledge base content
- When you give us your website during onboarding, we read its public pages so your receptionist can answer questions about your prices, hours, services and areas covered. We read what any visitor could read; we do not log in to anything.
- Call data
- For calls we answer on your behalf: the caller's phone number, the audio of the call, a transcript, a written summary, the time and duration, and anything the caller supplies to book — typically a name, a contact number, an address and a description of the job.
- Booking and demo data
- If you book a demo through the scheduler on our site, the name, email and time slot you enter.
- Billing data
- Subscription status and billing history. Card details are entered directly with our payment processor and are never stored on our systems.
- Technical and usage data
- IP address, browser and device type, referring page, the pages you view and how you move through the product. Used to keep the service running, secure and usable.
4. Why we use it, and our legal basis
Under UK GDPR we must have a lawful basis for every use of personal data. Ours are:
- To provide the service — performance of a contract
- Creating and running your account, answering your calls, transcribing and summarising them, taking booking requests, and sending confirmations and reminders on your behalf.
- To take payment — performance of a contract
- Managing your subscription, invoices and renewals.
- To support you — performance of a contract, and our legitimate interests
- Answering your emails and WhatsApp messages, investigating problems you report, and looking at call logs when you ask us to work out what went wrong.
- To keep the service working and secure — legitimate interests
- Monitoring, debugging, preventing fraud and abuse, and improving call quality and accuracy. We use the minimum data needed and do not use it to make decisions about individual callers.
- To market to businesses — legitimate interests, or consent
- Sending updates and offers to business contacts. Every message has an unsubscribe link and we stop as soon as you use it.
- Advertising and measurement — consent
- Only where you have accepted advertising cookies. See section 9.
- To meet our legal obligations — legal obligation
- Tax and accounting records, and responding to lawful requests from authorities.
5. Recorded calls, and what you must tell your callers
Daygent records, transcribes and summarises the calls it answers. That is how the service works: without a recording there is no transcript, no summary and no booking.
If you are a Daygent customer, you are responsible for telling your callers that their calls are answered and recorded by an automated service, and for having a lawful basis for it. Daygent announces itself at the start of the call, but that does not replace your own privacy notice. Do not use Daygent on a line where callers routinely give health, financial or other special category data unless you have taken your own advice on it.
Call audio and transcripts are processed by third-party speech and AI providers so the receptionist can understand and respond. We use them under contracts that limit them to delivering the service to us, and we do not sell call data or hand it to anyone for their own marketing.
7. Where your data goes
Some of our suppliers are outside the UK and the EEA, including in the United States. Where data is transferred there, we rely on UK adequacy regulations, the UK International Data Transfer Agreement, or the EU Standard Contractual Clauses with the UK Addendum, together with additional safeguards where they are needed.
8. How long we keep it
- Account and business data
- For as long as your account is open, and for 12 months after you close it so we can deal with any billing or legal questions.
- Call recordings, transcripts and summaries
- 24 months, unless you delete them sooner from your dashboard or ask us to.
- Billing records
- Six years after the transaction, which is the period UK tax law requires.
- Website and usage data
- Up to 26 months, then deleted or aggregated so it no longer identifies anyone.
Closing your account removes your call data on the schedule above. If you want it gone sooner, ask us and we will delete it.
10. How we protect it
Data is encrypted in transit and at rest. Access is restricted to the people who need it, protected by row-level security and multi-factor authentication, and reviewed as the team changes. No system is perfectly secure, but if a breach affects your rights we will tell you and the Information Commissioner's Office within the timeframes the law sets.
11. Your rights
Under UK GDPR you have the right to:
- Ask for a copy of the personal data we hold about you.
- Have inaccurate data corrected.
- Have data deleted, where we have no overriding reason to keep it.
- Restrict or object to how we use it, including a right to object to direct marketing at any time.
- Receive your data in a portable, machine-readable format.
- Withdraw consent where consent is what we relied on, without affecting anything done before you withdrew it.
Email oliver@usedaygent.com and we will respond within one month. There is no charge. If you called a business that uses Daygent, please contact that business first — it is the controller of your call, and we act on its instructions.
If you are unhappy with how we have handled your data you can complain to the Information Commissioner's Office at ico.org.uk, or by calling 0303 123 1113. We would rather you came to us first so we can put it right.
12. Children
Daygent is a business tool and is not intended for children. We do not knowingly collect data from anyone under 16. If you believe a child's data has reached us, tell us and we will delete it.
13. Changes to this policy
We update this policy when the service or the law changes. The effective date at the top always shows the current version, and if a change materially affects you we will email you before it takes effect.
14. How to reach us
Questions about this policy, or a request about your data? Email us and we will come back within one month, usually the same day. If it is quicker to type it out, message us on WhatsApp — no need to save the number first.
